POLICIES ON PARKS AND PROPERTIES

 

GENERAL PRINCIPLES

Management of the parks and parcels owned by the East Chop Association will be guided by the following restrictions:  

1.  The said parcels shall not be subdivided or conveyed in part.

2.  No building, sign, outdoor advertising display, fence, mobile home, utility pole or other temporary or permanent structure shall be constructed, placed or permitted to remain on said premises.

3.      No soil, loam, peat, gravel, sand, rock or other mineral substance shall be excavated or removed or dumped on the said premises.  Refuse, trash,   debris and any other unsightly or offensive material shall not be placed, stored, dumped, or permitted to remain on said premises.

4.      Tenting or camping shall not be permitted on the said premises.

5.      Automobiles, trucks, motorcycles, other powered vehicles, and boats shall not be driven, parked or stored on any part of the said premises, except for maintenance activities and for use by emergency and fire fighting vehicles during an actual emergency.

6.      No trees, grasses or other vegetation shall be cut or otherwise destroyed on the said premises.  This restriction shall not be construed to limit the right of the Association to maintain said premises in a natural state and to selectively thin or prune trees, brush or other vegetation to improve the scenic view and to implement disease prevention measures. 

 

MAINTENANCE PERMITS

The East Chop Association submitted to the Oak Bluffs Conservation Commission a Vegetation Management Plan in the fall of 2002.  The plan requested a maintenance permit for the Association’s properties on the East Chop bluff and the land abutting Crystal Lake.  A 5 year maintenance permit was approved by the Commission in 2003. The general project description of this project was referenced in an Order of Conditions that is on file in the Dukes County Registry of Deeds.

 

MANAGEMENT PRACTICES

1.  The Association will spend money wisely and equitably for the care of all parks and properties.  Particular emphasis will be made to those parks and properties offering the greatest benefit to the general public and as viewed from public ways

2.  The Parks chairman will improve the appearance and safety of the parks through the removal of dead, storm damaged and diseased trees.  The selective removal of live trees (under 4” in diameter) will be permitted to encourage the growth of sounder and more attractive trees.

3.  All requests regarding the cutting, pruning and maintenance on East Chop Association properties and parks must be approved in writing by the East Chop Association Parks chairman and in some instances by the Board of Directors.

4.  The removal on a single park or property of more than 3 live trees (greater than 4” in diameter) will be reviewed by the Parks Chairman. The Parks Chairman will make recommendations to the Associations President and the President may establish an ad hoc committee to secure input from local abutters.  The committee will submit a recommendation to the Board of Directors. The Directors shall use conservative judgment and discretion before authorizing any radical or drastic cutting of trees.  The Board of Directors will retain final responsibility and authority for the final decision.
